Maitland Shores Resort — Park Rules, Terms & Conditions

 


1. Scope, Acceptance & Season

  • Governs use of the Park from April 15 to October 31 each year.
  • Acceptance of this Agreement and full payment by May 10 required for gate access; non-compliance may result in access denial.

2. Definitions

  • Premises: All Park property including sites, docks, common areas, marina, etc.
  • Activities: All programs, events, recreational uses, and facilities on Premises.
  • Released Parties: Park, owners, employees, contractors, volunteers, affiliates, successors.

3. Seasonal Occupant Responsibilities

  • Maintain $1,000,000 liability insurance for all trailers, vehicles, watercraft, and property; proof required on request.
  • Keep trailers/sites clean, safe, and sanitary, including fire extinguisher and functioning smoke/carbon monoxide detectors.
  • Submit signed Licence/Lease by April 15 or access may be denied.
  • Internet/Wi-Fi available outdoors only; no guaranteed indoor signal quality.

4. Payment, Fees & Deposits

  • Full payment due by May 10; accepted: cash, cheque, debit, e-transfer; 3% surcharge on credit cards; NSF cheque fee $50.
  • Non-refundable $1,000 deposit due by October 15 to reserve next season’s site.
  • Hydro billed separately by meter readings (April 15, monthly, November 1).
  • No short-term rental or listing without prior written approval; registered occupant fully liable for renters’ actions.

5. Trailer Removal & Storage

  • No off-season removal without approval; unauthorized property after April 14 incurs $100/day storage fees plus taxes.

6. Termination of Occupancy

  • Early termination forfeits all fees; trailer/site must be removed and cleaned to Management’s satisfaction.

7. Site Use, Vehicles & Parking

  • One trailer and one vehicle per site unless approved.
  • Maximum speed: 10 km/h; violations fined 50–200.
  • Golf carts require drivers 16+ with valid license and site number displayed.
  • Only one vehicle through gate at a time.
  • No parking trailers/boats on roads, common areas, or vacant sites without approval.

8. Site Upkeep & Improvements

  • No construction or alterations without written approval; max shed size 10’x14’.
  • Landscaping/improvements are customer’s expense and responsibility.

9. Noise & Quiet Hours

  • No loud machinery after 8 PM; no heavy equipment Sundays post-June 1.
  • Quiet hours: Sun–Thu 11 PMFri–Sat 12 AM.

10. Seasonal Operation

  • Park operates April 15 – October 31 only; closed otherwise unless authorized.

11. Use at Own Risk

  • Use of all Premises and facilities is at Customer’s sole risk.

12. Garbage & Recycling

  • Household garbage only; recycling in blue bags by Monday 10 AM; metal and burnable materials in designated areas.

13. Pool & Water Safety

  • Children under 12 must be supervised; no glass or smoking; pool closes at 8 PM.

14. Trailer Eligibility

  • Trailers must be 10 years old or newer unless approved; unsafe units may be refused.

15. Trailer Sales

  • 7% commission plus HST on all on-site sales; buyers approved by Management; no signs; no sales of trailers 10+ years old without approval.

16. Motorized Equipment

  • Use only in designated areas; no operation near docks or pedestrian zones.

17. Storage

  • One complimentary storage space per site; additional spaces may incur fees.

18. Business Use

  • No commercial activity without written approval.

19. Tents & Guests

  • One overnight tent per site unless approved; must be removed by 10 AM.

20. Visitors

  • Customers are fully responsible for guests’ conduct.

21. Fires & Fireworks

  • Fires only in approved pits, 10 ft from structures; no unattended fires; fireworks prohibited without approval.

22. Water Use

  • Limited use; no lawn or vehicle washing without approval.

23. Pets

  • Maximum 3 pets per site; must be leashed; aggressive animals prohibited.

24. Gate & Security

  • Two gate keys/cards per site; do not admit unknown persons.

25. Restricted Areas

  • Unauthorized access/removal may be reported as theft.

26. Docks & Boats

  • Use entirely at owner’s risk; no fishing or unattended boats; Park not liable for damage or theft.

27. Permits

  • Required for all construction/improvements.

28. Utilities

  • Tampering prohibited.

29. Rule Changes

  • Park may update rules anytime; continued use means acceptance.

30. Enforcement

  • Violations may result in warnings, fines, suspensions, or termination.

31. Insurance

  • Minimum $1,000,000 liability insurance mandatory at all times.

32. Waiver, Release & Indemnity

  • Customers assume all risks and release Park and Released Parties from liability to the fullest extent permitted by Ontario law, including for injury, death, property damage, natural events, theft, utility interruptions, or acts of others.
  • Customers indemnify Park against all claims arising from their or their guests’ actions.

33. Limitation of Liability

  • Park’s maximum liability limited to the greater of $5,000 or total fees paid.

34. Legal Exceptions

  • Liability exclusions do not apply where prohibited by Ontario law.

35. Emergency Medical Authorization

  • Park authorized to obtain emergency medical assistance; Customer responsible for costs.

36. Proof of Insurance

  • Must be provided within 7 days of request or access may be revoked.

37. Arbitration & Governing Law

  • Governed by Ontario law; disputes resolved by binding arbitration.

38. Photo & Video Release

  • Park may use images/videos for promotional purposes.

39. Severability

  • Invalid provisions do not affect remaining provisions.

40. Notices

  • Delivered by email, mail, posting, or hand delivery.

41. Right of Entry & Inspection

  • Park may enter sites for inspections, maintenance, emergencies, or enforcement.

42. No Refund Policy

  • All fees and deposits non-refundable unless required by law.

43. Right to Refuse Service & Immediate Termination

  • Park may refuse or terminate occupancy for non-payment, violations, unsafe conduct, harassment, illegal activity, or damage.

44. Damage, Cleaning & Recovery Costs

  • Customers responsible for all damages, cleanup, towing, disposal, and legal costs.

45. Joint & Several Liability

  • Customers liable for actions of all guests, renters, visitors, and occupants linked to their site.

46. Abandoned Property

  • Park may remove, store, dispose of, or sell abandoned property at Customer’s expense.

47. Emergency Closure & Force Majeure

  • Park may close or restrict access for emergencies or uncontrollable events; no refunds.

48. Site Transfer & Assignment

  • No transfer or assignment of site rights without written approval; unauthorized attempts void.

49. Interpretation Clause

  • Park reserves right to interpret rules consistent with Ontario law.

50. Alcohol, Cannabis & Illegal Substances

  • Must comply with Ontario law; illegal use and unsafe behavior prohibited.

51. Harassment & Conduct Policy

  • Harassment or misconduct toward staff or guests results in immediate termination without refund.

52. Compliance with Laws

  • Customers must follow all federal, provincial, and municipal laws.

52B. ATV / Off-Road Vehicle Use

  • Permitted only in designated areas; helmets mandatory; no reckless driving; compliance with laws required.

53. Emergency & Evacuation Compliance

  • Customers must comply with emergency and evacuation directives.

54. Storm, Weather & Natural Events

  • Park not responsible for damage from natural events; customers must secure property.

55. Utility & Service Interruptions

  • No guarantee of uninterrupted utilities; no refunds for interruptions.

56. Off-Season Access & Winter Liability

  • Off-season access at Customer’s own risk; roads and utilities may be unmaintained.

57. Child Supervision

  • Parents/guardians fully responsible for minors.

58. Video Surveillance

  • Premises monitored for safety and security.

59. Removal, Towing & Storage Costs

  • Park may remove or tow property at Customer’s expense if not timely removed.

60. Entire Agreement

  • This document is the entire agreement and supersedes prior agreements.

Comprehensive Liability Waivers and Disclaimers

61. Comprehensive Liability Waiver & Disclaimer

To the fullest extent permitted by Ontario law, Customers acknowledge all use of the Premises, facilities, activities, roads, marina, docks, pool, and storage areas is at their own risk. Customers release Maitland Shores RV Park & Marina and Released Parties from all liability for injury, death, damage, loss, theft, or claims arising from any cause, including natural events, acts of others, utility failures, recreational activities, or negligence except where prohibited by law. Customers agree to maintain adequate insurance and indemnify the Park for all claims related to their or their guests’ use.

61A. Recreational Vehicle, ATV, Golf Cart, Watercraft & Activity Waiver

Customers recognize inherent risks in operating or using ATVs, golf carts, boats, trails, docks, pool, roads, and all recreational equipment or activities on the Premises. They voluntarily assume all related risks and agree to release and indemnify the Park and Released Parties to the fullest extent allowed by Ontario law. Customers ensure all operators are properly licensed, trained, insured, and equipped, and accept full responsibility for minors under their care.

61B. Third-Party Liability

Customers accept full responsibility for injury, damage, or loss caused by themselves or their family, guests, renters, employees, or invitees, and indemnify the Park against all resulting claims or expenses.

61C. Insurance Requirement

Customers understand the Park does not provide insurance for trailers, vehicles, watercraft, or personal property and are solely responsible for maintaining adequate coverage at all times.

61D. Assumption of Natural Risks

Customers acknowledge natural terrain, environmental hazards, wildlife, weather conditions, and outdoor risks on the Premises, voluntarily assume these risks, and release the Park from related liabilities.

61E. Guest, Visitor & Occupant Acknowledgement

Customers confirm they have informed all occupants, guests, renters, and invitees of these terms, and accept full responsibility for their compliance and actions, indemnifying the Park accordingly.

61F. Medical Fitness & Personal Responsibility

Customers acknowledge participation in activities requires personal judgment and physical fitness. The Park does not provide medical supervision and is not liable for health-related events except as prohibited by law.

61G. Personal Property

Customers are responsible for securing and insuring all personal property brought onto the Premises. The Park is not liable for theft, damage, or loss except where prohibited by law.

61H. No Warranty

All Premises, facilities, utilities, and services are provided “as is” without warranty of safety, availability, or fitness for purpose.

61I. Survival of Agreement

Waivers, indemnities, and obligations survive termination or expiration of occupancy.

61J. Electronic Signatures

Electronic or digital acceptance of this Agreement has the same legal effect as handwritten signatures.

61K. Customer Acknowledgement

Customers confirm they have read, understood, voluntarily accepted this Agreement, had opportunity for legal advice, and understand they waive certain legal rights to the fullest extent permitted by Ontario law.


62. Hunting, Firearms & Weapons

Hunting is prohibited unless specifically authorized. Firearms, weapons, explosives, fireworks, and similar items are prohibited except as permitted by law and Park approval. Violations may result in immediate removal without refund.

  • Speeding: 50–200
  • Quiet hours violation: $100
  • Unauthorized guests/tents: $100
  • Pet violations: $100
  • Failure to clean site: $150+
  • Unauthorized construction: $250+
  • Tampering utilities: $500+
  • Illegal dumping: $250+
  • Fire violations: $250+
  • Gate misuse: $100
  • Harassment/misconduct: Immediate termination
  • Reckless ATV use: $250+
  • Unauthorized short-term rentals: Immediate termination

Customer Acknowledgement:
By signing, the Customer confirms they have read, understood, and agree to fully comply with this Agreement, accept all associated risks, and waive certain legal rights to the fullest extent permitted by Ontario law.
